Picking a Term

How far back should the search go?

The useful question is not "how many years" but "how far back does this parcel's paperwork go." A lot in a subdivision recorded in 1978 can carry drainage and utility easements created on that original plat, and a 20 year search will not reach them. A lot in a development platted eight years ago has a short recorded history, and a longer term buys little.

Where a parcel has been split, assembled, or sold off in pieces, the access arrangements usually date from the split. That is the case for the 50 year term.

What the search does not cover

An easement search reports what was recorded against the parcel in the term searched. It is not a survey: it does not measure or stake where an easement sits on the ground. It is not a title commitment or a policy of title insurance. And it cannot show an easement that was never written down, such as a prescriptive claim arising from long use or an easement implied by necessity when a parcel was split.

Recording and indexing practice varies by county, and a record indexed incorrectly by the county may not surface under the parcel it belongs to. Where the stakes justify it, pair the search with a boundary survey and with counsel licensed in that state.

What does the price include?
The search itself, performed by a certified abstractor against the county land records for the parcel and term you select, and the report: every easement found of record with its recording date, book, and page, plus copies of the recorded instruments. There is no separate document retrieval fee for the instruments listed in the report.
Does a longer term find more easements?
Often, but not always. A longer term reaches further back, which matters most where the burdens on a lot were created when the subdivision was first platted or when a larger parcel was split. On a lot in a recent development, a 20 year search may cover the parcel’s entire recorded history. Call us with the address if you want help choosing.
Are these prices for residential property?
Yes. The 20, 30, and 50 year packages are priced for residential parcels. Commercial property, large acreage, multi-parcel assemblages, and searches with an unusual scope are quoted individually — send us the details and we will price it before anything is ordered.
How fast will I get the report?
A standard easement search is completed in 2 to 3 business days. Rush service is available. Turnaround can vary with the county, since recording and indexing practice differs from one jurisdiction to the next, so call before you order if you are working to a fixed date.
Is a search the same thing as title insurance?
No. An easement search is a report on what the land records show for the term searched. It is not a title commitment, not a title insurance policy, and not a title opinion. It also does not replace a boundary survey, which is what locates an easement physically on the ground.
